Peter J. McGinley

Peter McGinley represents companies and individuals in white collar litigation matters, complex business disputes, internal investigations, and enforcement actions involving the U.S. Department of Justice, Securities and Exchange Commission, and other government agencies. Mr. McGinley has experience in state and federal courts through all stages of litigation, from critical motions to appeals.

Mr. McGinley also maintains an active pro bono practice. In 2023, he successfully obtained asylum for a Venezuelan family living in the United States. Mr. McGinley presented a clear and well-founded case for asylum, prompting the U.S. Department of Homeland Security to stipulate to a grant of asylum on the papers, rather than proceed to an evidentiary hearing. Mr. McGinley also supervises a law student through the Penn Law Appellate Clinic, represents an indigent criminal defendant on appeal, and regularly files amicus briefs before the Supreme Court of the United States.

Prior to joining Dechert, Mr. McGinley served as a law clerk to the Honorable Thomas M. Hardiman on the U.S. Court of Appeals for the Third Circuit and the Honorable Gerald J. Pappert on the U.S. District Court for the Eastern District of Pennsylvania.

  • Representing an individual in connection with a multi-million dollar judgment and additional claims relating to a business dispute.
  • Represented a pharmaceutical distributor in a civil enforcement action by Department of Justice alleging non-compliance with Controlled Substances Act and related Drug Enforcement Administration regulations.
  • Represented an equities trader at a market-leading broker-dealer in connection with U.S. Department of Justice and Securities and Exchange Commission investigations into alleged improprieties in block trading.
  • Represented a steel rebar manufacturer in action against former director for theft of trade secrets.
  • Representing a major financial institution in parallel U.S. Department of Justice and Securities and Exchange Commission investigations into alleged cherry-picking.
  • Representing major energy supplier in a U.S. Department of Justice investigation and a state Attorney General and various civil litigations arising out of a public corruption inquiry in Ohio.
  • Represented the president of a prominent liberal arts college in U.S. Department of Justice and Food and Drug Administration investigation relating to the university’s use of COVID-19 rapid tests.
  • Defending prominent lender in dispute involving application of pooling and servicing agreement for mortgage-backed securities bond program.
  • Advising a market leader in college athlete representation.
  • Representing publicly-traded closed-end management investment company in U.S. Department of Justice antitrust investigation.
