The implications of the Supreme Court's McDonnell ruling for the FCPA

A ruling by the US Supreme Court could give defence lawyers leverage to fight back against the expansive use of the Foreign Corrupt Practices Act.

While it is unlikely to have a direct e ect on FCPA enforcement, the Supreme Court’s decision on 27 June to vacate the conviction of former Virginia governor Bob McDonnell on public corruption charges is a sign that prosecutors may have to take a narrower interpretation of white-collar criminal laws.
