Both employees and employers can benefit from the regulations. The transfer regulations (Tupe) may not be the first thing that springs to mind when contemplating moving a team from one organisation to another. Employers’ attention tends to focus on senior-level responsibilities, contractual duties, confidentiality obligations and post-termination restrictive covenants.
